Markhush is a brand operated by Markmaker Creative Inc.
These terms govern your use of Markhush (markhush.com). By generating a preview or purchasing a brand kit, you agree to them.
1. The service
Markhush generates AI-created logo concepts and, on purchase, a complete set of correctly-sized files for the platform(s) you choose. Free previews require no payment information. Paid tiers are a one-time payment — Markhush does not run subscriptions, and you will not be charged again after your purchase.
2. Eligibility
You must be at least 18 years old, or have the consent of a parent or guardian, to make a purchase.
3. Accuracy of information
You're responsible for the accuracy of the business name, description, and email address you provide — these are used directly to generate your concepts and deliver your files.
4. Payment
Payments are processed by Stripe. Prices are shown in USD at checkout. You will not be enrolled in any recurring subscription.
5. What you receive — license, not copyright transfer
The copyright status of purely AI-generated artwork is a genuinely unsettled area of law — U.S. Copyright Office guidance suggests output with no meaningful human authorship may not be copyrightable at all, which means we cannot promise to "transfer" a copyright that may not exist to transfer. Instead, on completing your purchase, Markhush grants you a broad, perpetual license to use the logo and brand assets you receive for your business — on your website, social media, packaging, signage, and marketing materials — without further payment to us. We do not reuse your specific generated design for any other customer.
6. Your responsibility for trademark clearance
Markhush does not perform trademark searches or clear your chosen business name or logo against existing trademarks. You are solely responsible for confirming that the name and design you use don't infringe on another business's existing trademark rights before you use them commercially.
7. Prohibited use
You may not use Markhush to generate content that is illegal, infringes a real, identifiable brand or trademark, or depicts hateful, violent, or discriminatory symbols. We may refuse service or terminate access for violations of this or for automated/abusive use of the free preview system.

9. Service provided "as is"
Markhush is provided without warranty of any kind. We don't guarantee uninterrupted availability, and generated concepts are produced by an AI model — we don't guarantee any specific design outcome.
10. Limitation of liability
To the maximum extent permitted by law, Markhush's total liability to you for any claim arising from your use of the service is limited to the amount you paid us.
11. Governing law
These terms are governed by the laws of the Province of Ontario, Canada.
12. Changes to these terms
We may update these terms, and any of our other policies, at any time and without prior notice. Continued use of Markhush after a change means you accept the updated terms. We encourage you to review this page periodically.
